General Terms and Conditions
1. Scope
The following terms and conditions apply to all orders through our online shop by consumers.
A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. An entrepreneur is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.
These terms and conditions also apply to future business relationships with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to them.
2. Contract partner, conclusion of contract
The purchase contract is concluded with the company ROSAMIX UG, Haslacher Straße, 1/1, 89081, Ulm.
The presentation of products in the online shop does not constitute a legally binding offer but an unverbindlich online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. By clicking the order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by e‐Email immediately after submitting the order.
When the contract with us is concluded depends on the payment method you have chosen:
Prepayment
We accept your order by sending a declaration of acceptance in a separate e‐Email within two days to, in which we will provide you with our bank details.
Credit Card
By placing the order, you simultaneously transmit your credit card data to us. After your authentication as the rightful cardholder, we request your credit card company to initiate the payment transaction and thereby accept your offer.
PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.
SOFORT Direct Transfer Procedure
After placing the order, you will be redirected to the website of the online provider SOFORT GmbH, where you confirm the payment instruction to SOFORT GmbH. This is how the contract with us is concluded.
Cash payment on collection
We accept your order by sending a declaration of acceptance in a separate e‐Email within two days to.
3. Contract language, contract text storage
The language available for concluding the contract is German.
We save the contract text and send you the order data and our terms and conditions by e‐mail. You can view the contract text in our customer login.
4. Delivery Conditions
In addition to the stated product prices, shipping costs will be added. Details on the amount of shipping costs and the respective shipping times can be found in the offers. We only deliver by shipping. For this, we use shipping service providers (e.g., DHL) at our discretion. Unfortunately, self-collection of the goods is not possible.
Shipping costs are 4.90 €. For orders of 49.00 € or more, we deliver free of charge within Germany.
European Union: For a merchandise value under 89 euros, we charge a shipping fee of 9.90 euros within the European Union (Austria 8.00 €). Shipping is free within the European Union for orders of 89 euros or more.
5. Payment
Prepayment
If you choose the payment method prepayment, we will provide you with our bank details in a separate e‐Mail and deliver the goods after payment receipt.
Credit Card
By placing the order, you simultaneously transmit your credit card data to us.
After your authentication as the legitimate cardholder, we immediately request your credit card company to initiate the payment transaction after the order. The payment transaction will be carried out automatically by the credit card company, and your card will be charged.
PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or register first, authenticate yourself with your login details, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction.
The payment transaction will be carried out automatically immediately afterwards by PayPal. Further information is provided during the ordering process.
SOFORT Direct Transfer Procedure
After placing the order, you will be redirected to the website of the online provider SOFORT Überweisung. To pay the invoice amount via SOFORT Überweisung, you must have an online banking account enabled for SOFORT Überweisung participation with PIN/TAN procedure, authenticate yourself accordingly, and confirm the payment instruction to us. Further information is provided during the ordering process. The payment transaction will be carried out immediately afterwards by SOFORT Überweisung, and your account will be charged.
6. Retention of Title
The goods remain our property until full payment is made.
For entrepreneurs, the following applies additionally: We reserve ownership of the goods until full payment of all claims from an ongoing business relationship. You may resell the reserved goods in the ordinary course of business; all claims arising from this resale are assigned to us in advance up to the invoice amount – regardless of any connection or mixing of the reserved goods with a new item – and we accept this assignment. You remain authorized to collect the claims, but we may also collect the claims ourselves if you do not meet your payment obligations.
7. Transport Damage
If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay. Failure to report or contact us has no consequences for your statutory claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
8. Warranty and Guarantees
The statutory warranty law applies. Information on any additional warranties and their exact conditions can be found with the product and on special information pages in the online shop.
9. Liability
We are always fully liable for claims due to damages caused by us, our legal representatives, or vicarious agents.
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- in case of warranty promises, if agreed, or
- as far as the scope of the Product Liability Act applies.
In case of breach of essential contractual obligations, the fulfillment of which makes the proper execution of the contract possible in the first place and on which the contracting party can regularly rely (cardinal obligations), caused by slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage at the time of contract conclusion, which typically must be expected. Otherwise, claims for damages are excluded.

We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
